1. Éditeur et Service
Fournisseur : TJM TECH, SASU au capital de 1 000 €, 369 Avenue Marcel Castie, 83000 Toulon, France, SIRET 952 741 700 00019, RCS Toulon 952 741 700, TVA FR26952741700 (« Fournisseur », « nous »).
Service : « Exercise Generator » – conversion d’exercices PDF en fichiers Moodle XML. « Site » désigne https://exercisegenerator.com et « Application » désigne https://app.exercisegenerator.com (ensemble, le « Service »).
2. Acceptation & éligibilité
En créant un compte (connexion sans mot de passe par e‑mail) ou en utilisant le Service, vous acceptez les présentes CGU/CGV. Les consommateurs doivent avoir au moins 18 ans. Si vous agissez pour une organisation, vous garantissez être habilité à l’engager.
3. Compte & accès
Connexion via lien/code à usage unique envoyé par e‑mail. Vous êtes responsable de la sécurité d’accès à votre messagerie et des activités depuis votre compte. Partage de compte interdit. Accès automatisé/API interdit sans autorisation écrite préalable.
4. Offres, facturation & taxes
Abonnements mensuels ou annuels TTC (EUR) avec renouvellement tacite. Paiements via Stripe. Résiliation par vos soins via le portail client Stripe ; effet à l’échéance de la période payée. Aucun remboursement ni avoir (y compris périodes partielles). Professionnels en France : intérêts de retard légaux et indemnité forfaitaire de 40 €.
5. Usage raisonnable & limites
Usage humain normal par enseignants et organisations. Nous pouvons instaurer/adapter des limites qualitatives ou quantitatives (p. ex. taille de fichier, pages, conversions) et un bridage technique. Nous pouvons suspendre/restreindre tout usage abusif (scraping, usage robotisé/systématique).
6. Contenus & propriété
Vous restez propriétaire de vos PDF et êtes propriétaire des Moodle XML générés. Vous nous concédez une licence non exclusive pour héberger, traiter et transmettre vos contenus aux seules fins de fournir le Service, d’assurer le support/la sécurité et d’améliorer le Service (données agrégées/anonymisées), conformément à la Politique de confidentialité.
7. Traitement & conservation
Les PDF, XML générés et journaux (debug/erreurs) peuvent contenir des données personnelles. Nous agissons en qualité de sous‑traitant pour ces données. Conservation jusqu’à 72 h (livraison/diagnostic), puis suppression. Les sauvegardes peuvent en capter de manière incidente (rotation ≤ 30 jours).
8. Prestataires & transferts
Prestataires : hébergement (OVH), e‑mail/SMTP (OVH), analytics sur le Site uniquement (Google – responsable distinct), télémétrie de l’Application via la plateforme d’hébergement (Lovable), et prestataires d’IA/OCR. Certains traitements peuvent avoir lieu hors EEE. Nous utilisons les CCT et des analyses d’impact transfert ; nous désactivons la rétention/formation côté prestataire lorsque possible. En utilisant le Service, vous consentez à ces transferts tels que décrits dans la Politique de confidentialité.
9. Niveaux de service & maintenance
Obligation de moyens, sans garantie de disponibilité. Maintenance possible à tout moment. Support par e‑mail legal@exercisegenerator.com (horaires/délais variables selon l’offre).
10. Usages interdits
- Contenus illicites, notamment données de mineurs sans base légale ;
- Atteinte à la PI, à la vie privée, ou contournement de limites techniques ;
- Scraping/convertions systématiques sans accord, revente sans consentement ;
- Logiciels malveillants, perturbation/surcharge du Service.
11. Propriété intellectuelle
Nous et nos concédants conservons tous droits sur le Service et ses éléments. Droit d’usage limité, non transférable, révocable, pendant l’abonnement. Licence gratuite sur vos retours pour améliorer le Service. Autorisation d’utiliser votre nom/logo comme référence (désinscription possible sur demande).
12. Modifications
Nous pouvons modifier les présentes pour des raisons opérationnelles, juridiques ou de sécurité. Les changements matériels seront notifiés avec un préavis de 15 jours lorsque possible. L’usage après la date d’effet vaut acceptation.
13. Responsabilité & garanties
Service fourni « en l’état ». Exclusion des dommages indirects (perte de profit, données, clientèle, interruption). Consommateurs : responsabilité totale limitée aux frais payés au cours des 12 derniers mois. Professionnels : au plus élevé de 1 000 € ou des frais payés au cours des 12 derniers mois. Ces limites ne s’appliquent pas aux responsabilités ne pouvant être limitées (ex. décès/blessures, dol) ni aux droits impératifs du consommateur.
14. Indemnisation
Vous nous garantissez contre toute réclamation liée à vos contenus illicites, votre violation des présentes ou toute contrefaçon due à vos éléments. Aucune garantie d’éviction fournie par nous.
15. Données personnelles / DPA
Notre Accord de sous‑traitance (art. 28 RGPD) fait partie intégrante des présentes : instructions documentées, confidentialité, sécurité, sous‑traitants sous autorisation générale avec préavis 15 jours, assistance droits/personnes, notification de violation ≤ 72 h, suppression à 72 h (sauvegardes ≤ 30 jours), audits sur arrangement.
16. Droit applicable & tribunal compétent
Droit français. Compétence exclusive des tribunaux de Toulon. Le consommateur peut bénéficier des règles impératives applicables.
17. Information consommateur
Vous demandez l’exécution immédiate et renoncez expressément au droit de rétractation de 14 jours.

1. Provider & Service

Service: “Exercise Generator” — converts PDF English exercises into Moodle XML files. “Website” means https://exercisegenerator.com and “App” means https://app.exercisegenerator.com (together, the “Service”).
2. Acceptance & eligibility
By creating an account (passwordless, email‑based sign‑in) or using the Service, you accept these Terms. Consumers must be 18+. If you use the Service on behalf of an organisation, you represent that you’re authorised to bind it.
3. Account & access
Sign‑in uses a one‑time link/code sent by email. You’re responsible for securing access to your email and for activity under your account. Account sharing is prohibited. Automated/API access is not permitted without our prior written consent.
4. Plans, billing & taxes
Monthly or annual subscriptions including VAT (EUR) with **auto‑renewal**. Payments via Stripe. You cancel via your Stripe customer portal; cancellation takes effect at the end of the current paid period. No refunds or credits (including partial periods). For French B2B customers: statutory late‑payment interest and the €40 recovery fee apply.
5. Fair use & limits
Normal human use by teachers and organisations. We may implement or adjust qualitative/quantitative limits (e.g., file size, pages, conversions) and technical throttling. We may suspend/restrict abusive or abnormal use (e.g., scraping, robotic/systematic use).
6. Content & ownership
You own your PDFs and you own the generated Moodle XML. You grant us a non‑exclusive licence to host, process and transmit your content solely to provide the Service, troubleshoot/secure it, and improve the Service (using aggregated/anonymised metrics), per the Privacy Policy.
7. Processing & retention
Uploaded PDFs, generated XML and related debug/error logs may contain personal data. We act as a processor for these. We retain them for up to 72 hours for delivery and troubleshooting, then delete. Backups may incidentally capture such data and are retained only on a rolling basis (≤ 30 days).
8. Third‑party services & transfers
Third‑party providers include hosting (OVH), email/SMTP (OVH), website analytics on the Website only (Google — separate controller), app‑level telemetry via the hosting platform (Lovable), and AI/OCR parsing. Some processing may occur outside the EEA. We rely on SCCs and transfer impact assessments and disable provider data retention/training where available. By using the Service, you acknowledge and consent to such transfers as described in the Privacy Policy.
9. Service levels & maintenance
Best‑efforts only, with no uptime guarantee. Maintenance may occur at any time. Support by email at legal@exercisegenerator.com; hours/response times may vary by plan.
10. Prohibited uses
- Unlawful content, including minors’ personal data without a lawful basis;
- IP/privacy violations; reverse‑engineering or bypassing limits;
- Automated scraping/systematic conversions without permission; reselling without consent;
- Malware; interference with or overloading the Service.
11. Intellectual property
We (and our licensors) retain all rights in the Service and its components. You receive a limited, non‑transferable, revocable right to use the Service during your subscription. You grant us a royalty‑free licence to use feedback to improve the Service. You authorise us to use your name/logo as a customer reference; you may opt out by notice.
12. Changes
We may update these Terms for operational, legal or security reasons. Material changes will be notified with at least 15 days’ notice where feasible. Continued use after the effective date constitutes acceptance.
13. Liability & warranties
The Service is provided “as is.” We are not liable for indirect or consequential losses (including lost profits, data, goodwill, or business interruption). Consumers: our aggregate liability is limited to the fees paid in the last 12 months. B2B/pro users: the greater of €1,000 or the fees paid in the last 12 months. These limits do not apply where liability cannot be limited by law (e.g., death/personal injury due to our act, fraud) and to mandatory consumer rights.
14. Indemnities
You will indemnify us against claims arising from your unlawful content or use, your breach of these Terms, or infringement caused by your materials. We do not provide an IP infringement indemnity.
15. Data protection / DPA
Our Data Processing Addendum (GDPR Art. 28) forms part of these Terms: documented instructions; confidentiality; security; subprocessing under general authorisation with 15‑day notice; assistance with data‑subject rights; breach notice ≤ 72 hours; deletion within 72 hours (backups ≤ 30 days); audits by arrangement.
16. Governing law & venue
French law. Exclusive jurisdiction: Courts of Toulon. Consumers may benefit from mandatory protections of their local law where applicable.
17. Consumer information
You request immediate performance and expressly waive the 14‑day right of withdrawal.
